at the moment i am (re)designing my own website to promote my services as an audio technician. i have samples of my work (videos and music) which are (and always will be) free to download. i will not be making money from the content of the site, but hopefully from my services irl...

Stevie,

The purpose of a "portfolio" website if to promote your services, which, in turn is a commercial endeavor unless you're working for free. So you need a license for the player to use it legally on your site.

it's not really to promote my services per se, more my skills - i am not advertising my skills for hire etc.

so as i'm currently looking to obtain an unpaid work placement, that qualifies for non-commercial use?

Do you work for free as an audio technician? If yes, you don't need a license. If you charge for your services, then you need a license.

Darjan, in consideration of your comments above, could you please explain the meaning of the license notes on this web site, as you seem to render them null:

"THE OVA FOR AS3 LICENSE

The OVA for AS3 product is offered under the terms of GNU GPL V3 and concurrently under a commercial license. This approach is called dual licensing. It does not harm the terms of GNU GPL and enables commercial entities, that do not wish to comply with GPL, more suitable terms. From a licensing perspective, the software is made available as two different products, depending on their usage and distribution, though technically the source code is identical.

Our open source license ( GNU GPL v3.0) allows one to freely copy, distribute, modify and compile all OVA for AS3 software. It also allows one's software to be linked or otherwise used with OVA software if it is provided under a GNU GPL compliant open source license."

Martin,

My response to Stevie C above was in regards to the player. The JW Player and the OVA for AS3 plugin are two separate products and they don't share the same license terms.

I hope this clarifies your concern.

Hi i'm currently working on a company that provides paid services. however the player will be utilize on a free help site does this require a license?

the videos by the way are redistributable and we dont have ads on that site

Alex,

If a company uses the player they need to obtain a license for it. The purpose of a company is to make money. Only non-profit organizations and educational institutions aren't required to purchase a license.

Hi,

I beg your pardon for hijacking this thread but since I also have a question wether we need a commercial license I didn't want to open a new thread.

Our situtation is as follows:
Our company is working on a website for a governmental department.
The purpose of this website is for citizens to apply for subventions.

Nothing is charged and no ads are displayed. We want to use the jw-player to provide videos on frequently asked questions.

In my understanding we won't need a commercial license. Is this correct?

Kindly,
Sebastian

Sebastian,

If the player is going to be used on a website for a governmental department you don't need a license.

All companies are required to purchase a license if they want to use the player on their website.

We plan on purchasing a license, because we are a company and we do plan on selling our product.

But instead of placing the player on our web site, we want to include the player in a downloadable training product which includes both text and videos that a reader can view in a web browser while offline.

Is this use of the player in this way permissible under the terms of the license?

There's a clause in the license prohibiting redistribution. But we're not redistributing or reselling the player as a video player, we're just including it as a tool to view our training content.

Mark,

Can you contact us at sales ]at[ longtailvideodotcom with your inquiry? If you bundle the player in a downloaded training product you'll need an enterprise license.

Cheers,

Darjan
