Using JW Player in a WordPress theme for sale

Hi,
I'm curious to know if I need a commercial licence to use JW Player in WordPress themes that would be sold on WP Marketplaces?
I see that some of the themes on those places have your player but they also have a JW watermark in the lower left corner of the player, and also on the right click.

In the scenario above you need to purchase a license for the player every time you sell your Wordpress theme. You can do this through our reseller program. I recommend that you send an email to sales ]at[ longtailvideodotcom so that we can set you up with an account.

If you, on the other hand, did not charge for your WP theme then you could use the free, non-commercial version of the player. But since you will be making money by having bundled our products with your themes, a license would be required.

Correct me if I'm wrong , but i see a lot of themes with your player which has JW Player watermark, like this one http://bit.ly/no4FsU

Is that okay or do I still need a licence?

On further inspection, and talking to a few authors from ThemeForest, I've concluded that they are showing their themes with the JW Player, but they are not including the player in the files that get downloaded with the theme, after purchase.
They just provide a link to the zip file of the player, and instructions how to include it in the theme.
So basically they are circumventing the whole licence issue.

Darjan, I am completely confused about licensing. Above you write:

So if a user installs a Free WP theme and that free them includes the non-commercial version of the player, then the user of the theme -- ie. a web site -- can make use of the theme including the player without having to switch from non-commercial to commercial player?

I am most concerned about whether or not it is acceptable to use the plugin located at http://rodrigopolo.com/about/wp-stream-video without obtaining a commercial license. You will see the plugin is free.

Martin,

As an end-user -- the person who'll ultimately use the theme -- you don't need a license for the player as long as you don't have ads on your website, or if you don't represent a company. In this scenario, you can use the free, non-commercial version of the player for your hobbyist website (for example).

If you, as a developer, are selling your theme, which is using the player, then you need to obtain a unique license for each copy of theme you sell.

On the other hand, if you distribute a theme for free, you can use the free, non-commercial version of the player.
