Dear Ladies and gentlemen,
I'm designing a website for some clients and I'm a bit confused about the term "commercial use".
For starters: I don't intend to remove the right click JW" attribution. This is how I found out about the player (http://www.alfredbrendel.com/recordings.php) and I would be proud if anyone else would benefit from this link as I did.
What I'm just a bit confused about is what qualifies as commercial use.
Case 1: A website for two professional musicians advertising their work and achievements as well their music school. I was asked to integrated some videos and mp3 of their work and immediately thought about integrating JW Player. Because they "advertise" their own work, there is certainlay a commercial background to this project.
Case 2: An art society (NPO) presenting videos on their homepage of their various exhibitions. The society itself is non commercial, yet the videos are showing the work of various artists, that have VERY commercial interests (though most of them would deny that...) and there will be links to their homepages. Also, there was talk about integrating a donate button to support the art society.
I hope, that case number two is of the non-commercial kind. What about number one?
So please, I need some illumination.
Regards,
pepebe

I just noticed the "Why buy a licence" box to the right...
you cannot use a JW Player on
(i) a site that has ads;
(ii) a corporate site; or a
(iii) CMS.
Does this mean, I can't integrated the player into a cms like for example MODx, Textpattern, Drupal or Joomla! ?
Thats a serious problem. Not only for me, but for about everyone doing websites nowadays. Proove me wrong, please!

I am running a videostreaming server for a Community College (2 year) for our nursing program. We are streaming pre-recorded material and possibly some original material. What do you consider colleges to be?
Apr. 02, 2009Judy
"you cannot use a JW Player on
(i) a site that has ads;
(ii) a corporate site; or a
(iii) CMS."
But they also said that an artist site cannot use this plugin as a noncommercial but an artist's site does not have ads, is not corporate (maybe if you're talking Hollywood), and most likely does not use a CMS.
What about anyone who promotes their skills or services on their site?
This is really confusing!
Apr. 03, 2009Adam LongTail
@pepebe - Case 2 is non-commercial as long as NPO is non-commercial.
Also, you left out the most important part of the quote: "IF YOU DON'T BUY A COMMERCIAL LICENSE, you cannot use a JW Player on (i) a site that has ads; (ii) a corporate site; or a (iii) CMS."
This means that you CAN use a JW Player on ANY SITE as long as you buy a commercial license.
@GWCmcraig - non-profit colleges are considered non-commercial.
@Judy - anyone who promotes their skills or services on a site is doing so for commercial purposes, hence those are considered commercial sites.

We have a license for the player.
Can you tell me what is the difference in the downloads of licensed and non-licensed players.
Also if i have make code changes where do i get the code from for licensed version. Is it different from the tagged code.
If i download the code to make modifications, do i need to use the licensed fla files in that to modify?
Please can you clarify my questions.
Apr. 06, 2009Adam LongTail
@MG - the difference between the compiled licensed and un-licensed player is the watermark.
The code for the licensed version, however, is the same source code as the unlicensed.

Thanks Adam...

I writing a .NET app to use commercially. I don't plan on using the JW player found on this site, however I found a .NET control from http://www.beansoftware.com/Free-ASP.NET-Controls/JW-FLV-Control.aspx. They say it's free and there isn't any info. on licensing that I can find. Since they say they use your JW Player, do I need to get a license?
Apr. 16, 2009Adam LongTail
Yes, you still need a license for the player if you're using it on a commercial site.
Apr. 18, 2009Dan
Is it commercial if the site is a fan site about a tv program?
Apr. 20, 2009Maria
Hello,
I have a web shop for Hunting Products (xtcommerce shop), and I want to use the flv Player to show how to use some products (for example how work a winch).
Must I pay a licence?
King Regards
Maria
Apr. 21, 2009Adam LongTail
@Dan - Yes, that's a commercial site.
@Maria - Yes, a web shop is a commercial site, hence you must buy a license.
Apr. 22, 2009Maria
ok, the next question ist: I have 4 shops, but 2 from them are the same, only for another land, I have to pay for 3 or 4 shops? How much cost for 3 or 4 shops if this is my situation?
Another thing, I saw somebody wrote about a watermark, I have not any watermark in my version... what about this?
Apr. 22, 2009Adam LongTail
@Maria - the number of licenses you need is tied to the number of sites, not the number of stores. For instance, if you have one store on abc.store.com and another store on def.store.com, then you only need one license. But if your two stores are on storeabc.com and storedef.com then you need two licenses. Hope this makes sense, please ask if you have more questions.
Apr. 23, 2009Maria
die situation ist: www.store.de (germany) and www.store.at (austria). The same products, same template, the only diference ist the Vat (19% ans 20%), the use conditions and the domain (.de and .at)
Apr. 23, 2009JeroenW
@Maria - you should buy two licenses. There's a discount if you buy a double license on our Order Page here:
https://www.longtailvideo.com/players/order

I am interested in possibly using this player for video display on sections of my university's web presence.
As we are an educational institution, I was wondering if we would be required to purchase a licence.
There are currently only two uses we have for it.
1. A video of a recorded lecture to be accessible only to university members (staff & students)
2. Lecture materials - to be displayed to students
Thanks

hello. I have a blog with my personal tutorials how to use Linux. I use JW flv player some times to show screencasts how to install some software in Linux. I have google adsense on the top of my page just to keep my site working, not for profit. the main ideea of the site is not to obtain money. so do I need also to buy a license??
Apr. 24, 2009Maria
@JeroenW, but I need a license for this 2 shops plus 1 shop more, another one, from us too. So, I need 3 Licenses, but I see only I can buy 2 or 10, 10 is too much. Must I buy 10 licenses?
Apr. 24, 2009Josh
Hi Guys,
Have built a site and now wish to incorporate your product, Whilst my site is commercially orientated, ALL and ANY profits derived are used for development and educational programs for youths,
Do I therefore need to purchase a "commercial" license?.
Thanking you in anticipation of your reply.
Apr. 29, 2009Adam LongTail
@Josh - You must buy a commercial license.
@Maria - Please contact us directly using our contact us form http://www.longtailvideo.com/support/contact-us regarding this issue and we'll give you a discount code.
@andre - You must buy a commercial license.
@JarrodR - You do not need to buy a license unless you wish to remove the JW branding from the player.

We operate a 501c3 (NPOTE) that creates, aggregates, and stores VOD for other 501c3's. Do we need to purchase a single or multiple commercial license(s)? I understand that to remove the JW branding a commercial license is needed. If the videos are being played from our site do we need one or more licenses?
May. 11, 2009Adam LongTail
@Dimi] - If you are removing the player branding for multiple sites, then you must buy one license for each site that displays the player w/o the branding.
May. 16, 2009DimiJ
Do you have pricing for unlimited licenses, such as embedding the player in a CMS? The reason I ask the question is that some of our non-profit clients are using the same CMS and that CMS has JWPlayer as its embedded player. I point the user to our site for video acquisition, but the video is played from the CMS which is already an unbranded player. That unbranded player can be modified by using JW Flashvars and I have done so successfully. How do we account for that scenario? Here is the URL of one such site: http://ccc.adventist.org/on-demand-tv . . . Or do we need to count each customer as they come on and pay by the site?
May. 18, 2009Adam LongTail
@Dimij - we do offer an enterprise license for CMSs. Please contact us direct @ biz dev [at] long tail video dot com and we'll quote you a price.

Hi,
I am looking to use your product in a website and information CD for a church. The site is to give information about a free course that the church is running for its members. The church is of course a charity.
Do I need a commercial licence for this use? If so then how does putting a copy of the site onto a CD for distribution fit into the 1 licence per site rule?
Thanks.
May. 27, 2009Adam LongTail
@Rowan - you are welcome to use the player for free as long as you don't remove any of the JW branding or JW attribution in the right-click. Otherwise, pls contact us about purchasing an enterprise license.

Hello -
I am looking for a MP3 Player for a clients website but I am unclear if a license is required.
This is for an elderly retired musician who simply wants to put their music on their site for people to listen to and download for free.
Does this require a license?
Thank you

Hi, I want to use the player on 2 intranet websites - for showing a movie about one of our community event for example.
It seems to be a non commercial context - could you confirm that license is not needed ?
Thanks in advance for your answer

Do I need a license for a NOT-for-profit organization. That's different than a non-profit. Not-for-profit means that our members are for-profit companies but our association itself makes no money.
Thanks.
Jul. 23, 2009Ruben Colon
Hi,
We are a Foundation part of the public group Universitat de Barcelona and we use Moodle offen. We are considering if we can use the same flv player for our main web. Could we?
Thank you in advance.
Jul. 23, 2009Adam LongTail
@Denise - if the musician still does paid performances or sells any music whatsoever, then a license is required. You can purchase one here:https://www.longtailvideo.com/players/order
@Caisr - As long as the community organization is non-profit, then no license is required. However, you cannot remove any attribution, the right-click link or the watermark.
@SV - Not-for-profit organizations do not require a license. However, you cannot remove any attribution, the right-click link or the watermark.
@Ruben Colon - A public non-profit group does not require a license. However, you cannot remove any attribution, the right-click link or the watermark.

Hi, we are a postproduction company using a typo3 generated website (aaron-film.de). a showroom is prepared to be filled. I wonder If a can use your player?
Thanke,
Tobias.
Aug. 06, 2009Adam LongTail
@Tobias - you are welcome to use our player, just make sure that you purchase a separate license for yourself and each of your clients. You'll note that we do sell a 50-site license, however, this license is only good for one company. Hence, if a company owns 50 domains, then they can simply purchase a 50-site license. But if you are using the player for 50 clients, each a different company, then you must purchase 50 separate licenses. Hope this is clear.
Aug. 18, 2009Tobias
@ Adam - we only have 1 site. What would be the price for it? please contact me off-list at tobias.trummer@aaron-film.de if possible.
have a nice day,
Tobias.

We are an IT company and would like to use your wmv player in our intranet portal for General Security Awareness for our employees. This is not for any commercial purpose but only awareness. Let me know if we need to buy a license for this.

Dear Adam,
do we need a licence for the site:
http://wettlauf-um-die-alten.com/
no ads, no commercials, no products, it's a pice of code in a cms field (it's _not_) coupled with cms drupal, the player code only pasted into the textfield by hand.
thanks for your answer,
Andreas

I'm using siteX 0.7.4, it's a GPL-CMS. But you are write,
a CMS needs a license for using JW FLV-Player. But my website is a private page with private videos, so I think, I don't need a commercial license for embedding JW FLV-Player in siteX 0.7.4-CMS. Is it correct, what I mean?

I can't read German, but I don't think you need a license as long as you're not a for-profit entity and you're not selling anything or generating any direct or indirect revenue from the site.

Hello, I'm trying to use JW player for church sermon videos and audios, maybe announcements also. Would this be considered as commercial?. Oh, please say no. Couldn't find a better one all over the net. :-)
I read Rowan's post up there and it seems almost certain that church use is non-commercial. But to make sure that church use is in fact non-commercial and the license is free, I'm posting this thread just minutes before using it. Thanks for the great product in advance. :-)
